US accuses Walgreens of filling illegal opioid prescriptions

Walgreens Boots Alliance, one of the largest pharmacy chains in the United States, is facing serious allegations. The U.S. Department of Justice has accused the company of contributing to the current opioid epidemic by filling millions of illegal prescriptions for addictive drugs and other substances. The move comes after revelations that Walgreens ignored "red flags" and dispensed drugs without a legitimate medical reason.

According to the allegations, Walgreens $WBA intentionally filled illegal prescriptions for controlled substances, allowing millions of drugs to flow illegally from their pharmacies.

Further, the charge relies on violations of the Controlled Substances Act because Walgreens knowingly filled illegal prescriptions and then sought reimbursement from federal health programs, such as Medicare, for these illegitimate drugs. The Justice Department also charged the company with violating the False Claims Act, thereby obtaining funds from taxpayer-funded programs based on false information.

Recently, Walgreens filed its own lawsuit against the new rules, which they say were implemented by the DEA (Drug Enforcement Administration) without due process. The company argues that the newly implemented rules are arbitrary and do not allow pharmacists to properly respond to difficult situations. "We will not stand by and let the government push our pharmacists into impasse situations with rules that simply do not exist," the company said in a statement.

Walgreens already agreed in 2022 to pay out up to $5.52 billion over 15 years to settle thousands of lawsuits alleging the company contributed to the opioid epidemic in the United States. The move is part of a broader problem where various pharmacy chains, drug manufacturers and distributors are facing allegations and out-of-court settlements across the country.

Last year, a $650.9 million judgment obtained by two local counties against Walgreens, CVS and Walmart was overturned by Ohio's top court in the first-ever national case to address allegations of contributing to the opioid crisis.

As a result, Walgreens faces serious legal consequences and liability issues for contributing to one of the largest public health crises in the United States.
